Terms
These terms cover the Am I the Jerk and Am I the Genius giveaways and Rip & Ship at amithejerk.com.
GIVEAWAYS
Giveaways are free to enter and no purchase is necessary. To enter, leave a comment on the corresponding YouTube video. Comments on Am I the Genius and on our Spotify episodes can sometimes count too. On YouTube, make sure you are subscribed with the bell on. On Spotify, follow the show. If an entry comment is deleted, by anyone and for any reason, that entry no longer counts. Entries that use multiple accounts or abuse the process can be disqualified.
We either choose a comment or use a random comment picker. Some videos have multiple winners, some have zero. Past winners can win again. A winner may be announced in a future video, sometimes much later than the video they commented on. Nothing about a giveaway is guaranteed, including whether one is running, prizes, prize contents, timing, winner counts, or announcements.
Winners are announced on screen. If you are announced, you have 14 days from the date that announcement was first published to DM us on Instagram at amithejerk. Reruns, re-uploads, clips, and reposts of an announcement do not restart or reopen that window. We cannot respond on Instagram to accounts that are not following us, so make sure you are following before you DM. To make sure the prize goes to the right person, we usually ask you to prove the winning comment is yours through the account that posted it. The only account that will ever contact you about a win is amithejerk on Instagram. Anyone else claiming otherwise is a scammer, and we never ask for payment or card details. If a winner does not come forward in time, we may pick a new winner or add the prize to a future giveaway pool.
Being announced does not make you a winner, and being verified does not guarantee a prize. Nothing is final until the cards are actually on their way to you. We can withdraw a win at any stage, before or after verification, for example if the person is not eligible, cannot prove the comment is theirs, breaks these terms, if the prize is lost or no longer available, if we made a mistake or missed something on our end, or for any other reason. We run this ourselves, so slips happen. If a win is withdrawn, we may pick someone else, return the prize to the pool, or simply move on, and no compensation is owed.
Verified winners get a one-time claim code by DM. Claim codes are single use and expire 14 days after the winner announcement was first published, no matter when the code was sent, and there are no extensions. A code only works for the prize it was issued for and only for the Instagram account we sent it to. The listed price on the prize page is a placeholder so that prizes cannot be claimed without a code, and a valid code brings it to $0. Any order for a prize placed without a valid claim code is void and will be cancelled. When you claim, use an address you know you will be at for a while, since there can be a gap between winning and when we are able to ship. Submitting a claim is the final settlement of that giveaway, and the cards shipped for that claim are full and final.
Prizes are generally mystery cards from our giveaway pool. The pool changes over time. We add cards to it from time to time, including cards we buy just for the pool, cards from packs we open off camera, and cards from anywhere else. Cards also leave it as prizes go out, donations are made, or the pool is rotated. Cards shown on camera are not automatically in the pool, and what is in the pool at any moment is up to us. Sometimes we show cards from our personal collection just for fun. Those stay ours unless we choose to add them to the pool. Some prizes will be great cards and some will not. That is how a mystery pool works. Entering is free and you can win more than once. When we open Pokemon packs, most come with an official Pokemon TCG Live code card. Those code cards are not included in any shipment, since their codes are usually already revealed on camera.
Giveaways are open to US residents aged 18 and older. Winners are responsible for any taxes that may apply. Forfeited or unclaimed prizes are sometimes given to charity and sometimes added to future giveaway pools.
As with any free giveaway, we can change, pause, stop, or cancel a giveaway at any stage, for any reason or no reason. All decisions about entries, winners, and prizes are final. If you feel like sharing a photo of your cards when they arrive, we would love to see it.
PLATFORMS
Our giveaways are not sponsored, endorsed, administered by, or associated with YouTube, Google, Instagram, Meta, X, Spotify, Apple, or The Pokemon Company. By entering, you release those companies from anything related to a giveaway. Entries must follow the rules of the platform they are posted on, and comments that break them are disqualified. Info you send us to claim a prize is used to run the giveaway, ship your cards, and contact you about the show, including future giveaways, Rip & Ship, and news. It is not sold, and it is not shared beyond what shipping requires.
RIP & SHIP
A Rip & Ship slot is the purchase of one sealed pack that we open on camera and ship to you. Cards from a Rip & Ship slot belong to the buyer and are never part of the giveaway pool. Slots are for US buyers aged 18 and older. Slots are limited and are shown on the site when available. All sales are final.
Packs are sealed randomized products. No specific cards, values, or outcomes are guaranteed, and pulls have no promised worth. Rip & Ship packs are opened on our schedule, so there is no guaranteed opening date. If a product becomes unavailable, we may substitute a comparable pack or refund the slot.
SHIPPING
US addresses only. We batch ship, generally every month or every few months, so please expect delays. Cards usually ship in regular stamped envelopes with no tracking unless we say otherwise. Shipping method, packaging, and timing are up to us and can change without notice. If something makes shipping a prize impractical, we may delay it, ship it a different way, or substitute it. Cards ship raw, as pulled, with basic protection, and can still be damaged or lost in transit. Carriers are outside our control, and damaged or lost shipments are not replaced or reimbursed.
CARD DONATIONS
At checkout for a Rip & Ship slot, you choose what happens to your cards: ship everything, donate the non-rares, or donate all of them to charity. For a prize claim, you choose to ship everything or donate all of it to charity, since prizes are a mystery. Donated cards are not shipped.
STORY SUBMISSIONS
Sending us a story, on our subreddit or anywhere else, gives us permission to read, adapt, and use it in episodes, clips, and anywhere the show appears, without payment. Only submit stories you have the right to share. Names and details can be changed. Submissions are not returned and are not kept private.
THE FINE PRINT
Events outside our control, including platform outages, carrier problems, supply issues, or anything else unexpected, can delay or cancel giveaways, Rip & Ship, or shipping without compensation. Nothing here runs on a promised schedule. Prizes and slots have no cash value. Honest mistakes on camera or in fulfillment may be corrected at our discretion, and our records are final. Goodwill gestures, past practice, and things said in videos or DMs do not create obligations beyond these terms. If you break these terms or the law and that leads to a claim against us, you agree to cover the resulting costs and damages. Everything we offer is provided as is, and our total liability for anything connected to the site, a giveaway, a Rip & Ship slot, or shipping is limited to what you paid us for the item involved, which for a free giveaway is zero. These terms are governed by the laws of the State of Nevada. These terms can be updated at any time, and the posted version applies.
